Acceptable Use Policy

What is and is not allowed in DomaAI - including the AI, the Agent that runs code and a browser, and the social module.

Language of the agreement. This is the English version of the document, provided for the convenience of international users. The language of the contract is Polish; in the event of any discrepancy between language versions, the Polish version prevails. The binding Polish original is available at madd.im/regulamin.html and in the document centre. Nothing in this translation limits consumer rights arising from mandatory provisions of Polish and EU law.

This document forms an integral part of the Terms of Use and sets out what is and is not allowed in the DomaAI application, including use of AI, the Agent that runs code and a browser, and the social module. Provider: MADD Marcin Kisielinski, contact [email protected].

1. General principle

Use the Application lawfully, in good faith and with respect for the rights and safety of others. You are responsible for all prompts, content and actions taken from your Account - including tasks delegated to the Agent.

2. Prohibited content and conduct

It is prohibited to use the Application to create, transmit, generate, publish or obtain content, or to take actions, which:

2.1. Endanger people and children

  • child sexual abuse material (CSAM) or any sexualisation of minors - an absolute prohibition, reported to the competent authorities,
  • threats of violence, incitement to violence or attacks against persons or groups,
  • instructions for making weapons (including weapons of mass destruction: chemical, biological, radiological, nuclear), explosives or other means of causing serious harm,
  • content promoting suicide, self-harm or eating disorders.

2.2. Are unlawful or harmful

  • content infringing Polish or EU law,
  • hate speech, discrimination, harassment, defamation,
  • fraud, scams, phishing, misleading disinformation,
  • malware, exploits, tools for unauthorised access or attacks,
  • invasion of privacy, doxxing, unlawful processing of other people's personal data.

2.3. Infringe third-party rights

  • infringement of copyright, trade marks, patents or trade secrets,
  • impersonating other people, entities or the Provider,
  • generating misleading content that passes off as authentic statements or likenesses of real persons (deepfakes) without a legal basis and clear labelling.

2.4. Constitute practices prohibited under Article 5 of the AI Act

It is prohibited to use the Application for: subliminal or purposefully manipulative techniques that materially distort a person's behaviour to their detriment; exploiting vulnerabilities due to age, disability or socio-economic situation; social scoring of natural persons; assessing the risk of committing a criminal offence solely on the basis of profiling; untargeted scraping of facial images to build facial recognition databases; inferring emotions in the workplace or in educational institutions; biometric categorisation revealing special categories of data.

2.5. Constitute technical abuse

  • reverse engineering, decompilation, attempts to bypass security measures, moderation or limits,
  • automated bulk querying (scraping) of the Application, overloading the infrastructure, DoS attacks,
  • unauthorised access to Accounts, data or systems,
  • using the Application or its output to train competing AI models or build competing services,
  • sharing or reselling the Account, credits or access contrary to the Terms of Use.

3. Specific rules for the Agent (code, shell, browser, file downloads)

3.1. On your instruction the Agent may run code and shell commands, browse the web and download files. You must not use these features to:

  • scan, attack or gain unauthorised access to other people's systems and networks,
  • bypass security measures, paywalls, captchas or the terms of use of other services,
  • obtain data in breach of the law or of third-party terms,
  • attempt to access internal infrastructure resources (the execution environment is isolated and protected against such attempts; circumventing these safeguards is prohibited),
  • download or run malware.

3.2. You use the Agent features at your own risk and are responsible for the consequences of the actions you instruct towards third parties. The above does not exclude or limit the Provider's liability which cannot be excluded under mandatory law, in particular towards consumers.

4. Content moderation

4.1. Prompts submitted to image and video generation are moderated: by a local filter blocking critical content (including CSAM, threats of violence, weapons of mass destruction) and by an external moderation system. Content that breaches the rules is blocked before the operation is performed, and no credits are charged.

4.2. Moderation may operate in fail-open mode if the external service is unavailable - this does not relieve the User of the obligation to comply with this Policy.

4.3. The Provider may log violation events (in a minimised form, e.g. content hashes) for security purposes.

5. Content in the social module

Publishing and sharing content in the social features is additionally subject to the Publishing and Sharing Policy.

6. Reporting violations

Violations of this Policy, illegal content or copyright infringements can be reported to [email protected]. The copyright procedure is described in the notice-and-action document.

7. Consequences of a breach

In the event of a breach the Provider may - proportionately to its seriousness - warn the User, remove content, restrict features, suspend or delete the Account and, where it suspects an offence threatening the life or safety of persons, notify the competent law enforcement authorities (Article 18 of the Digital Services Act). These provisions are applied with respect for consumer rights and the principle of proportionality; the User receives a statement of reasons for the measures applied in accordance with the Publishing Policy.
